Regulation
My profession as a notary is regulated by the Faculty Office, and not by the Solicitors Regulation Authority. I am also regulated by the Legal Ombudsman.
My role and the role of a notary in England
Unless I have prepared the documents my role is limited to ensuring that the documents are signed in accordance with the requirements of the country in which they will be used. This will include establishing your identity and also to establish that you have an understanding of the documents and their effect and that you wish to be bound by them; please see the limits on legal advice below.
Legal Advice
I am not qualified to advise on any law other than the laws of England and Wales. You must rely upon other lawyers representing you as to their use and effect in any foreign jurisdiction. Where I am requested to draft documents upon your instructions, it is your responsibility to ensure that your instructions are in keeping with the requirements of the receiving foreign jurisdiction.
Charges
My professional charges are based upon the time and work involved in each matter, including the number of notarial acts required of me. Payment is due when the documents are signed. I am not able to accept cheques or payment by cards. My current charges are at the rate of £300.00 per hour (excluding VAT if applicable and any disbursements) and any notarial work undertaken is unlikely to be less than £60.00. I can usually give a fixed quotation once I have seen the document/s.
Other payments
In addition to my charges payments may have to be made to the Foreign and Commonwealth Office, Consulate and postal and courier companies or disbursements for drafting documents and/or other administrative charges. These charges are in addition to my professional charges.
Copies
I am not required to keep copies of most of the documents that I deal with but I do keep copy of notarised act/ document and your photo IDs & address which are eventually scanned on my computer and kept for up to 12 years.
Liability
Where I post documents, I am not responsible for their loss, or other direct or indirect losses that you may incur, as a result of them going missing or are delayed whilst in transit. I carry professional insurance in respect of any claims for that I carry out for you.
Data Protection
I am registered under the Data Protection Act and these terms are subject to my Data Protection Privacy Notice which can be found at: www.harbanssinghnotarypublic.com. Any information I hold and your personal details will not be passed on to third parties. My regulator makes occasional inspections of the notary records and may inspect information that I hold without notice to you, and where authorised by law, copies may be given to police and other competent bodies, authorities or person/s. Complaints
- If you are dissatisfied about the service you have received
please write to me by email or post.
- If we are unable to resolve the matter you may then refer the matter to the Notaries Society, of which I am a member, who have a complaints procedure. This procedure is free to use and is designed to provide a quick resolution to any dispute.

- After your complaint is considered under the Notaries Society Approved Complaints Procedure, if you are still not happy with the result, you may within 6 months of the end of that procedure refer the matter to the Legal Ombudsman.

Applicable Law
The laws of England and Wales apply to these terms of business and the services that I supply. Unless the work I am required to do turns out to be more complex or time consuming than anticipated, I shall carryout the work for you for the agreed.

Whilst no responsibility is taken for the contents of the document/s not drafted in my office, please check the accuracy of the document/s that you sign in my presence before you leave the office.
Acceptance of terms
Prior to any work undertaken the Person/s instructing me shall be asked to acknowledge receipt of these terms of business and accept them and sign and date and retain a copy of the terms of business and to confirm that he/she/they have thoroughly checked the document/s and that they are correct in every aspect.
